1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you andMahdi Kazempour Marketing Management Co. L.L.C S.O.C ("MKMM", "we", "us", or "our") governing your access to and use of our website, platform, and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

MKMM provides:

  • Integration with Google Maps, Instagram, and WhatsApp
  • AI-powered content generation and booking assistance
  • Analytics and tracking for business pages
  • Public directory listing for businesses
  • Custom domain support
  • Blog and SEO tools

3. Account Registration

3.1 Eligibility

To use our Services, you must be at least 18 years old and have the legal authority to enter into these Terms. If you are using the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.

3.2 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities under your account.

3.3 Account Security

You must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from unauthorized access to your account.

4. Acceptable Use

You agree not to:

  • Use the Services for any illegal purpose or in violation of any laws
  • Post false, misleading, or fraudulent business information
  • Impersonate another person or business
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any part of the Services
  • Use automated means to access the Services without our permission
  • Upload content that is defamatory, obscene, or infringes intellectual property rights

  • Use the Services to compete with us directly
  • Reverse engineer or attempt to extract source code from the Services

5. User Content

You retain ownership of content you submit to the Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and promoting our Services.

5.2 Content Standards

You are responsible for ensuring your User Content is accurate, does not violate any third-party rights, and complies with applicable laws. We may remove User Content that violates these Terms.

5.3 Third-Party Content

Content imported from Google Maps, Instagram, or other third-party sources is subject to those platforms' terms of service. You represent that you have the right to use such content.

6. Payments and Subscriptions

6.1 Pricing

Pricing for our Services is displayed on our website and may be changed at any time. Changes to pricing will not affect existing subscriptions until renewal.

6.2 Payment Terms

Subscriptions are billed in advance on a monthly or annual basis. Payment is due at the start of each billing period. We accept major credit cards and other payment methods as displayed at checkout.

6.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

6.4 Free Trial

Free trials may be offered at our discretion. At the end of a free trial, your account will automatically convert to a paid subscription unless cancelled.

7. Intellectual Property

7.1 Our Property

The Services, including all software, design, text, graphics, and other content (excluding User Content), are owned by MKMM and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

7.2 Feedback

Any feedback, suggestions, or ideas you provide about the Services may be used by us without any obligation to you.

8. Third-Party Services

Our Services integrate with third-party services including Google, Instagram, WhatsApp, and payment processors. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for third-party services and make no warranties regarding their availability or functionality.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure. We do not guarantee any specific results from using the Services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MKMM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless MKMM, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services, your User Content, or your violation of these Terms.

12. Termination

12.1 By You

You may terminate your account at any time by contacting us or using account settings.

12.2 By Us

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our discretion. We will provide notice when reasonably possible.

12.3 Effect of Termination

Upon termination, your right to use the Services ceases immediately. Your User Content may be deleted. Provisions that by their nature should survive termination will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in Dubai, UAE, except that either party may seek injunctive relief in any court of competent jurisdiction.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the modified Terms.

15. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Services.
  • Waiver: Failure to enforce any provision is not a waiver of that provision.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Assignment: You may not assign your rights under these Terms without our consent.
